When will these people ever learn? This is casuistry at its worst. This is what give lawyers a bad name.

Once again, the Geneva Convention does not have a loop hole to pidgeon-hole a "enemy combatant" category. There are those who are clearly militia. They get immunity from prosecution for acts of belligerence. In return, they can be killed without liability under the same set of circumstances that give rise to their immunity and when they are captured, they are guaranteed a minimum specified level of protection. Then, there are the rest. These non-militia people are given a higher level of protection, i.e., protection under criminal law. You can only kill them in self defence, but then if they commit any crime, like killing a soldier or throwing a bomb, they can be prosecuted to the fullest extent of the law. They are subject to the death penalty after a fair process. You can't torture either group of people to get intelligence.
