It seems like Judge Robertson says that these Guantanomo detainees are prisoner of war, they have to be tried by court-martial, but if they are not prisoners of war, then they must be tried by "regularly constituted court affording all judicial guarantees which are recognized as indispensable by civilized peoples" (whatever that means). No grey area of "enemy combatants" who can be manhandled anyway we like. What do you say, Professor Yoo?
